These Terms of Service ("Terms") govern your access to and use of AGAVE Engage ("AGAVE", "we", "us"), a multi-tenant platform for building, publishing, and routing leads from short-form courses. By creating an account or using the platform, you agree to these Terms.
1. Your account
To use AGAVE you must register a workspace and provide an email address. You are responsible for keeping your credentials confidential and for all activity that happens under your account. You must be at least 18 years old.
2. Subscription, trials, and billing
New workspaces receive a 14-day free trial. After the trial you may continue on a paid plan billed monthly via Stripe. Plans renew automatically until canceled. You can cancel anytime from the Stripe customer portal accessible at /admin/billing.
Failed payments enter a 7-day dunning window. If the payment is not recovered, your workspace is suspended. Your data is preserved for 60 days after suspension; restoring service restores access automatically.
3. Acceptable use
You agree NOT to use AGAVE to:
- Publish content that is unlawful, harassing, hateful, or infringing.
- Distribute malware, phishing pages, or deceptive content.
- Reverse-engineer, scrape, or interfere with the platform's operation.
- Resell access to AGAVE as a white-labeled product without an Enterprise agreement.
- Send unsolicited bulk email through any AGAVE-controlled sender.
We may suspend or terminate workspaces that violate this section without notice when public safety or platform integrity is at stake.
4. Your content
You retain ownership of the courses, media, questions, and lead data you create on AGAVE. You grant us a non-exclusive license to host, copy, transmit, and display your content solely to operate the service. We never sell your content or your learners' data to third parties.
5. Learner data
AGAVE processes anonymous learner sessions by default and stores explicitly-submitted lead information (name, email, phone) only when the learner submits a lead-capture step. You are the controller of that data for GDPR / CCPA purposes; AGAVE is the processor.
6. Third-party services
AGAVE integrates with third-party services (Firebase, Stripe, Resend, GoHighLevel, Vercel) to deliver functionality. Your use of those services is governed by their own terms.
7. Termination
You may delete your workspace at any time by contacting support@agavelms.app. Upon deletion we remove your data within 60 days, except where retention is required by law (e.g., payment records).
8. Warranties and liability
AGAVE is provided "as is" and "as available". To the maximum extent permitted by law, our total liability for any claim arising from these Terms or your use of the service is limited to the amount you paid us in the 12 months preceding the claim.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
